These Terms of Service explain how Kyros AI Agency provides its managed website chat system, Neo, and what clients agree to when using our services.
Agreement to these terms
These Terms of Service apply to your use of Kyros AI Agency services, including our website, demo booking process, onboarding process, managed website chat system, and related services. By using our website, booking a demo, or purchasing services, you agree to these terms.
Services
Kyros AI Agency provides a managed website chat service for business websites. Our service may include assistant setup, configuration, website integration support, lead capture workflows, appointment booking support where available, routing or escalation rules, monthly reporting, and ongoing management based on the selected plan.
Specific features, timelines, deliverables, and support levels may vary by plan or written agreement.
Client responsibilities
Clients are responsible for providing accurate business information, service details, policies, contact information, booking preferences, website access, approvals, and other materials needed to configure and maintain the service.
Clients are responsible for reviewing the information used by the AI assistant and notifying Kyros when important details change, including business hours, services, pricing, promotions, staff availability, policies, or contact details.
Assistant limitations
Neo is an AI-powered assistant and may generate incorrect, incomplete, or misunderstood responses. Kyros works to configure and manage Neo responsibly, but no website system can be guaranteed to be perfect, uninterrupted, or error-free.
Neo should not be used as the sole method for emergencies, legal advice, medical advice, financial advice, safety-critical decisions, or any matter requiring licensed professional judgment.
Third-party services
Kyros may use third-party platforms for scheduling, email, analytics, assistant processing, website hosting, automation, reporting, payments, or related service delivery. These third-party services may have their own terms, privacy practices, outages, limitations, or pricing changes.
Kyros is not responsible for delays, failures, or interruptions caused by third-party services outside our reasonable control.
Payments and billing
Setup fees cover implementation, onboarding, configuration, and launch preparation. Monthly service fees cover ongoing management, maintenance, reporting, and support according to the selected plan.
Unless otherwise stated in writing, setup fees are due before implementation begins and monthly fees are billed on a recurring basis. Failure to pay may result in delayed setup, paused service, disabled features, or termination.
Cancellations and refunds
Clients may cancel monthly service before the next billing cycle. Cancellation stops future monthly billing but does not automatically refund completed setup work, past monthly service periods, or work already performed.
Because Kyros performs custom setup and implementation work, setup fees are generally non-refundable once work has begun. Monthly service fees are generally non-refundable for billing periods already started, unless Kyros states otherwise in writing.
No guaranteed results
Kyros aims to improve website engagement, lead capture, appointment booking, and visitor support. However, Kyros does not guarantee a specific number of leads, appointments, sales, revenue, conversions, or business outcomes.
Results depend on many factors outside Kyros's control, including website traffic, offer strength, market demand, client responsiveness, service quality, and customer behavior.
Confidentiality and client information
Kyros will use reasonable care to protect non-public client information shared for setup and service management. Clients should not provide sensitive personal information, regulated data, private credentials, or confidential business information unless it is necessary for the service and appropriate safeguards are in place.
Acceptable use
Clients may not use Kyros services for illegal activity, deceptive practices, spam, harassment, discrimination, malware, unauthorized data collection, or any use that violates applicable laws or third-party rights.
Kyros may suspend or terminate service if the service is used in a harmful, unlawful, abusive, or high-risk way.
Intellectual property
Kyros retains ownership of its pre-existing materials, processes, templates, workflows, configuration methods, reporting formats, designs, and internal systems. Clients retain ownership of their business information and materials provided to Kyros.
Unless otherwise agreed in writing, clients receive a limited right to use the configured service during the active subscription period.
Service changes and availability
Kyros may update, improve, modify, pause, or discontinue parts of the service as needed for security, reliability, performance, vendor changes, or business reasons.
Kyros will make reasonable efforts to maintain service availability but does not guarantee uninterrupted or error-free operation.
Limitation of liability
To the fullest extent permitted by law, Kyros is not responsible for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, or reputational harm.
To the fullest extent permitted by law, Kyros's total liability for claims related to the service is limited to the amount paid by the client for the service during the period giving rise to the claim, unless otherwise required by law.
Termination
Kyros may suspend or terminate service for non-payment, misuse, legal risk, repeated failure to provide required information, or violation of these terms. Either party may end the relationship according to the cancellation terms or any separate written agreement.
Updates to these terms
Kyros may update these Terms of Service from time to time. The updated version will be posted on this page with a revised date. Continued use of the website or services after updates means you accept the updated terms.
